Hoku AI ("we," "us") respects your privacy. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have. It applies to our website, our software services, and any communications we send to you.
1. Information We Collect
1.1 Information you provide directly
- Booking & qualification info: name, email, phone number, company name, business type, lead volume, current CRM, and the bottleneck you describe when you book a strategy call.
- Account info: billing contact, payment method (handled by Stripe — we do not store full card numbers), and any preferences or configurations you set up during onboarding.
- Communications: messages you send us via email, SMS, the contact form, or during calls.
1.2 Information we collect automatically
- Usage data: pages visited, time on page, referring URL, device type, browser, and approximate location (from IP).
- Cookies & similar technologies: small text files that help the site function (essential), measure usage (analytics), and remember preferences.
1.3 Information from your customers (sellers / leads)
If you are a Hoku AI customer, the Service stores and processes lead data that you provide — typically seller names, contact details, property addresses, and conversation history. You are the data controller for that lead data; Hoku AI acts as a data processor on your behalf and uses it only to provide the Service.
2. How We Use Information
We use information to:
- Provide, operate, and maintain the Service, including the AI workflows that text, DM, and email leads on your behalf.
- Process payments, send invoices, and manage your subscription.
- Communicate with you about your account, our services, security, and product updates.
- Improve the Service, measure performance, and develop new features.
- Comply with legal obligations, enforce our Terms, and protect our rights.
We do not sell your personal information, and we do not sell or share your seller / lead data with third parties for their own marketing purposes.
3. How We Share Information
We share information only with:
- Service providers we use to deliver the Service — including GoHighLevel (CRM & automation), Twilio (SMS & voice), Stripe (payments), Calendly (scheduling), Meta / Google (where you have authorized us to operate on your accounts), Formspree (form submissions), Netlify (hosting), and AI providers used to generate responses. These providers are contractually obligated to protect your information.
- Legal authorities when required by law, subpoena, or to protect the rights, property, or safety of Hoku AI, our customers, or the public.
- A successor entity in the event of a merger, acquisition, or sale of substantially all our assets — with notice to you.
4. SMS, Email, and DM Communications
The Hoku AI service sends SMS messages, emails, and direct messages on behalf of our customers. If you receive a message from one of our customers using Hoku AI, that customer — not Hoku AI — is the sender for legal purposes (TCPA, CAN-SPAM, etc.). All messages include opt-out instructions (typically reply STOP). We honor opt-outs at the platform level so the same number is not contacted further.
If you book a call with Hoku AI directly, we may send transactional messages (e.g., your Zoom link, calendar reminders). You can opt out of these by replying STOP or emailing us.
5. Data Retention
We retain your information for as long as your account is active and for a reasonable period thereafter to comply with our legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your account and associated data by emailing hello@hokuai.com; we will respond within 30 days, subject to any legal retention obligations.
6. Security
We use reasonable administrative, technical, and physical safeguards designed to protect your information. No system is 100% secure, however. If we ever become aware of a security breach affecting your personal data, we will notify you in accordance with applicable law.
7. Your Rights
Depending on where you live (e.g., California, the EU, the UK), you may have rights to:
- Access the personal information we hold about you
- Request correction or deletion of inaccurate or unnecessary data
- Object to or restrict certain processing
- Receive a copy of your data in a portable format
- Withdraw consent where processing is based on consent
- File a complaint with your local data protection authority

8. Children
The Service is not directed to anyone under the age of 18 and we do not knowingly collect information from children. If you believe a child has provided us information, please contact us and we will delete it.
9. International Users
Hoku AI operates from the United States. If you access the Service from outside the U.S., your information will be transferred to, stored, and processed in the U.S., which may have different data protection laws than your home country.
10. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be posted on this page with a new "Last updated" date. For significant changes, we will notify you by email or through the Service.
